A. There are numerous differences between a Chapter 7 and Chapter 13 bankruptcy. The main distinction is that a Chapter 7 bankruptcy is for individuals who are seeking to erase only credit card debt, medical bills, and past due utility bills (i.e. unsecured debt); whereas, a Chapter 13 bankruptcy is for individuals whose homes are being foreclosed on or listed for sheriff sale, or who are in danger of having their automobile repossessed. Q. What debts cannot be erased through a bankruptcy filing?
A. The federal bankruptcy law does not allow for the discharge of student loans, most tax obligations, child support and alimony obligations, and debts related to criminal activity. Q. How long will a bankruptcy filing appear on my credit report?
