DIVORCE

Do you know what to do when you are considering Divorce?

First, you should consider marriage counseling and other means of reconciliation; Second, you should know your legal rights, the effect it may have on you and your children, and what you may be entitled to.

How do I find out about marriage counseling?
Most telephone directories have a listing in the Yellow Pages under Marriage, Family, Child & Individual Counselors, or under Counselors & Human Relations.

How do I find out my legal rights and entitlements?
You should contact an attorney or contact the Court Administrator of the County in which you live. They can assist you in finding an attorney or direct you if you cannot afford an attorney.

Am I entitled to 50% of everything?
In most cases, no. Division of marital property can be by agreement between the parties, or by Court Order of Equitable Distribution. Property brought into the marriage, current financial status and other factors are all taken into consideration in an Equitable Distribution Hearing.

How long does a divorce normally take?
A minimum of 90 days once you file your Complaint and serve it on the other party.

Can I process my own divorce without an attorney?
You can go to the Prothonotary's Office of the County Courthouse where you live. They can provide you with the necessary paperwork to begin your divorce. BUT PLEASE NOTE, THEY ARE NOT PERMITTED TO GIVE LEGAL ADVICE OF ANY KIND.
